Michael Barasch of Barasch McGarry Salzman & Penson, PC, personal injury law firm in New York, was recently quoted in New York Newsday on the new 9/11 health care law

A longtime advocate of New York City firefighters and rescue personnel, Mr. Barasch represented the late James Zadroga, an NYPD officer and 9/11 first responder. The September 11th WTC Victim Compensation Fund, part of the Zadroga 9/11 Health and Compensation Act, is groundbreaking legislation intended to provide those suffering from injuries or illnesses related to exposure from the toxic World Trade Center dust and debris with compensation and health care.

However, the law passed without a provision to aid workers who had earlier agreed not to sue, in order to receive funds from the 2001 Victim Compensation Fund.

In the January 25, 2011 edition of New York Newsday on the 9/11 healthcare law, discussing these possible denials of compensation under the new law, New York personal injury attorney Mr. Barasch was quoted as saying, “It’d be tragic if the one thing these guys did wrong was not get sick enough quick enough to qualify for what now would be compensation rightfully owed to them under Zadroga.”

He also stated that many of those compensated seven years ago now suffer worsened conditions, and that number is “in the hundreds.” Mr. Barasch believes responders who have been forced into retirement in their late 30s or early 40s should receive “hundreds of thousands of dollars” each.
