Clinic That Treated Joan Rivers Sued for Medical Malpractice

March 12, 2015 | Dominique A. Penson

The daughter of the late comedian Joan Rivers recently filed a medical malpractice lawsuit against the outpatient clinic that treated her mother in the final week of her life. The clinic is the Yorkville Endoscopy Center on the Upper East Side of Manhattan, and treated Rivers in late August and of 2014, just days before her death.

Rivers suffered an episode of cardiac arrest while she was undergoing an examination of her vocal cords and throat at the Yorkville Endoscopy Center. The Centers for Medicare and Medicaid Services, an agency run by the government, recently engaged in an investigation that revealed that the facility had not met all of the conditions that are necessary in order to qualify for coverage to be a supplier of outpatient surgery. As a result of the investigation, the clinic has until late March to meet those conditions, otherwise it will face a loss of funding and federal accreditation.

The investigation was also the final straw for Melissa Rivers, who had contemplated filing a medical malpractice lawsuit against the facility in the past. The latest information reveals that there was likely negligence on the part of the Yorkville Medical Center in relation to Rivers’s death. The lawsuit claims that the clinic did not give Rivers the proper advisement as to the risks of receiving her treatment, and that the clinic recklessly disregarded her safety and wellbeing.
