Queens Man in Critical Condition After Pedestrian Accident

November 10, 2014 | Michael Barasch

A car accident in Queens caused some collateral damage recently, and now a pedestrian who suffered some severe injuries as a result of the accident is in critical condition in a New York hospital.

According to one of the drivers involved in the accident, the driver of a dark green Toyota Camry was exiting the parking lot of a nearby restaurant when he lost control of his vehicle and ran into the first driver’s Buick, which was then forced over the curb and onto the sidewalk. A pedestrian was walking by at that moment and was struck by the Buick, which caused some significant injuries.

The driver of the Buick instantly got out of his vehicle to check on the victim, and the driver of the Toyota remained at the scene. The Toyota driver claims that he lost control of his vehicle due to a brakes failure. This led to an investigation at the scene by police, who tested the breaks several times, and they appeared to be in fine working order. An investigation into the incident is still ongoing, and as of now there have been no formal charges filed in the incident.

In this type of case, the pedestrian would likely be able to file a personal injury claim against whoever is determined to have been liable in the accident. Based on the initial evidence that’s been reported, the driver of the Camry seems to have been at fault, but with investigations still pending it is difficult to say with certainty.
