Worker Dies in Construction Accident in Manhattan

November 24, 2014 | Michael Barasch

An accident in the Garment District in Manhattan led to the death of a construction worker, according to the Fire Department of New York. The FDNY was present on the scene responding to an accident call from a construction project located on West 37th Street near 8th and 9th avenues.

Investigators obtained video taken on a phone by a worker who was up above the scene of the accident. The victim was killed after being trapped beneath a large concrete slab that collapsed. It is unclear exactly how the slab fell, but it apparently was knocked from a corner where workers were doing some excavation work. The worker was trapped underneath, and the injuries resulted in his death. A nearby office building was evacuated after the accident as a precaution, but there were no more injuries that occurred to workers or passersby.

Construction workers often find themselves facing some significant dangers while on the job. Information from the Occupational Health and Safety Administration (OSHA) indicates that the construction industry is by far the leader out of all other industries in employee injuries and deaths, even after some decreases in total deaths in recent years.

When construction workers are injured or killed on site, there are a variety of legal options for the workers or their families. The workers could file a personal injury lawsuit against their employer if the accident was caused by negligence, or a workers compensation claim if no one was at fault in the case. The family of a construction worker killed in an accident could bring a wrongful death suit against the construction company if they are able to prove negligence on the part of the company.
