Still Time to Meet Deadlines for Filing 9/11 Claims

The James Zadroga 9/11 Health and Compensation Act of 2010 (Zadroga Act) reopened the 9/11 Victim Compensation Fund (VCF) to cover responders and individuals with post 9/11 illnesses not covered by the original fund.  However, only responders who suffered from an illness included on the list of WTC-Related Health Conditions were eligible for funds. Over time, though, as responders sickened — and some died — from illnesses not included on the list, it became clear that the list needed to be expanded.  As additional diseases were added to the list, new registration deadlines were created. The recent October 3 deadline related to one group of responders and individuals, but not all responders. If you missed the October 3 deadline it may not be too late to register for Zadroga Act benefits.

Zadroga Fund deadlines for non-October 3 registrations

Responders may believe that if they missed the recent October registration deadline, they have lost their rights to Zadroga benefits. However, the deadline for registering depends on the date when you knew, or reasonably should have known, of your 9/11-related illness.  The October 3, 2013, registration deadline applied only to responders and their families who knew (or reasonably should have known) of their 9/11 related illness since October 3, 2011.  Those injured before May 30, 2002 who did not qualify or apply for compensation from the first fund also had to register by October 3.

Those responders not covered by the October 3, 2012, date must register within two years of the date they learned (or reasonably should have known) that they suffered an injury as a result of the 9/11 attacks:

  • Responders diagnosed in the last two years with any respiratory illness linked to toxic WTC dust, must register within two years of their diagnosis.
  • Responders diagnosed with one of the 62 9/11-related cancers as of October 12, 2012, (the date the final rule adding cancers to the list took effect) must register by October 12, 2014.
  • Responders diagnosed with cancers covered by Zadroga before October 12, 2012, must register within two years of the date they learned or reasonably should have known of their cancer.

Regardless of when claimants registered with the Zadroga Fund, all claim forms for compensation must be received by October 3, 2016.
